Applying for Optional Practical Training (OPT) or a STEM OPT extension is stressful enough without worrying about massive government fees. Unfortunately, the cost of peace of mind just got higher.
Earlier this year, U.S. Citizenship and Immigration Services (USCIS) implemented a final rule that increased the filing fee for Form I-907 (Request for Premium Processing Service) to adjust for inflation. For F-1 students filing Form I-765 for OPT or STEM OPT, the premium processing fee is now a staggering $1,780.
This is in addition to the standard filing fee for Form I-765. So, is it worth paying nearly $2,000 just to get your EAD card faster?
What Does Premium Processing Actually Guarantee?
If you pay the $1,780 fee and file Form I-907 alongside your Form I-765 (either initially or as an upgrade while your case is pending), USCIS guarantees that they will take adjudicative action on your case within 30 calendar days.
"Adjudicative action" means they will either approve your application, deny it, or issue a Request for Evidence (RFE). If they fail to take action within 30 days, they will refund the premium processing fee and still process your case expeditiously.
When You SHOULD Pay It
- • Your job start date is within 45 days and your employer will rescind the offer if you don't have the card.
- • You applied very late in your 60-day grace period.
- • Normal processing times have spiked above 3-4 months.
When You Should SAVE Your Money
- • You applied 90 days before your graduation date (as recommended).
- • You are applying for STEM OPT (you receive an automatic 180-day extension while it's pending).
- • You don't have a job offer yet.
The STEM OPT Exception
If you are applying for a STEM OPT extension, you generally do not need premium processing. As long as you file your STEM OPT application before your current post-completion OPT expires, your work authorization is automatically extended for up to 180 days while the application is pending. Unless you need the physical new card for international travel or a very strict employer HR policy, save the $1,780.
How to Upgrade an Existing Application
If you already filed your Form I-765 standard and realize you need your EAD card immediately, you can upgrade to premium processing. You simply file Form I-907 online through your myUSCIS portal, link it to your pending I-765 receipt number, and pay the fee. The 30-day clock begins the day USCIS receives the upgrade.
